Terms and Conditions


These Terms and Conditions define the rules for accessing the online programming courses, organized and owned exclusively by Edutekie Coding and Technology School ("Edutekie", "we", "us"). Edutekie reserves the right to modify these terms at any time.


Description and registration

1. Edutekie offers online programming and technology courses. 

2. Access to this digital content requires payment.


Platforms used

1. Course content is delivered through the Edutekie platform (powered by Thinkific).

2. Checkout of the respective program is processed through our platform.


Course content

1. The course content can be viewed on this website and is subject to change.

2. The management company reserves the right to make any changes, corrections, and/or updates to the content of the courses, which the user hereby acknowledges and accepts.


Prices and payment

1. The course price is listed on this website and may be subject to updates/changes.

2. Payments are processed via Thinkific Payments.

3. The respective invoices will be made provided within a maximum period of 60 days via email.


Right of withdrawal

1. Under Decree-Law No. 24/2014 (Portuguese consumer law), users have 14 days to request a refund after subscription, unless expressly waived at purchase.

2. Refunds processed within 14 days via original payment method.

3. To formalize the refund request, the user must send an email to the following email address: [email protected].

4. Accessing any lesson/content or waiving withdrawal rights at checkout forfeits refund eligibility (Article 17, Decree-Law 24/2014).


Responsibilities

1. Edutekie Coding and Technology School undertakes to ensure that the information and material provided in the courses are free from errors or omissions, but accepts no responsibility for any inaccuracies in information provided by third parties.

2. Any malfunction of the aforementioned platforms is the sole responsibility of those platforms and cannot be attributed to the organizing company.

3. The customer declares that they are aware that, for reasons beyond the control of the managing company, there may be delays in the availability of course content, and that this should not constitute grounds for requesting a refund o

4. The customer declares that they are aware that course content is educational only - not professional coding certification or employment guarantee.


Deadlines and conditions for delivery of products

1. After payment confirmation, access to classes and materials will be provided within 24 hours.

2. Access will be provided through the Edutekie platform, and an email with login instructions will be sent to the parent/guardian email address provided by the User at the time of purchase.

3. If the User does not receive the access email within the stipulated period, they should contact Edutekie Coding and Technology School via email [email protected].


Intellectual Property Rights

1. The content to be shared in the courses, as well as all graphic, visual, and audio content contained on this website and in the online education courses, is the property of Edutekie Coding and Technology School.

2. The User acknowledges that the program is protected by copyright and related rights, industrial property rights, and other applicable legislation.

3. The User undertakes not to engage in any acts that may violate the law, namely, copying, reproducing, duplicating, commercializing, transmitting, or making course content available to the public, including:

i. Uploading any Edutekie Roblox Studio project files (games) or modified versions created as part of the course as public experiences on Roblox.

       ii. Sharing course templates/assets outside the Edutekie platform;

Violations result in cancellation of the user's access, without the right to refund of any amounts paid, without prejudice to civil liability and potential judicial action for intellectual property infringement.

4. The managing company reserves the right to modify the content of the courses, namely for updating purposes.


Personal data protection

1. By enrolling in the program, the User acknowledges that they may be asked to provide personal data, such as the student's name, parent/guardian's name, parent/guardian's email address, student's date of birth, and country.

2. The management company undertakes not to share Users' personal data with third parties without their authorization, except when necessary, namely with payment processors and Thinkific as needed.

3. The User guarantees that the personal data provided to the management company is true, assuming responsibility for communicating any changes to it.

4. Users' personal data may also be disclosed to third parties to satisfy requirements imposed by law or by the competent governmental or judicial authorities, or requirements necessary to initiate or sustain legal proceedings or defense in a lawsuit.

5. The user's personal data will be kept for the period necessary to comply with legal obligations.

6. The User may, at any time, request access to, rectification, and deletion of their personal data.

7. If the User wishes to exercise any of their rights, they should contact Edutekie Coding and Technology School, by email at [email protected].

8. The User also has the right to lodge a complaint with the National Data Protection Commission (which can be done via http://www.cnpd.pt/) or with the competent authority of the Member State where they consider that there has been a breach of the legal provisions on personal data protection.


Management of terms and conditions

The management of these Terms and Conditions of Business is the sole responsibility of Edutekie Coding and Technology School, which may therefore make changes to this website whenever it deems necessary or convenient, without prior notice to the User, who should therefore consult this page regularly.

Applicable legislation

1. Any dispute arising from these terms and conditions and from the commercial relationship

established by accessing and registering for this program shall be subject to Portuguese jurisdiction, with express waiver of any other, and Portuguese law shall apply in the interpretation of the legal and contractual terms in question.

2. In the event of a dispute, the consumer may resort to an Alternative Dispute Resolution (ADR) entity.
